Tenancy agreements
A tenancy agreement is a contract between a tenant and a landlord that stipulates the responsibilities of each party during the tenancy.
Although it is not a legal requirement for a tenancy agreement to be signed prior to a tenant moving in, it is advisable as it lays down certain ground rules for everyone to understand. The benefit for both the landlord and tenant is that they have a point of reference should a dispute arise.
If a written tenancy agreement is provided to a tenant, it should outline the following as a minimum:
- The type of agreement which the property is being let under
- The name and address of the landlord
- The start date of the tenancy
- The duration of the tenancy
- How much rent is paid each month, and by what means e.g. direct debit, cash, etc.
- What is included in the rent
- The amount of notice either party has to give prior to moving or asked to move out
The tenancy agreement should then be signed by both parties, each getting a copy of the agreement.
